Vive Privacy Notice

This Vive App (“App”) provides you with control of your personal data provided by you or collected by us when you use the App (“Data”). This Privacy Notice is intended to assist you in making informed decisions when using the App. Please take a moment to read and understand it. Please note that within this App you may be redirected to a Lutron website; in which case you should also review the privacy notice(s) provided for that website.

We do not sell your personal data.

This Privacy Notice explains the Data we collect and how we use that Data. The primary purpose of collecting Data is to provide you with the functionality to configure and control your Vive hub and the associated lighting control system via this App. For the App to function you must also purchase a Vive hub. To control your lighting control system via this App, the device on which you installed the App must have a Wi-Fi connection.

The Lutron Vive system permits Hub access by web browser or by the Vive App (App is not available in select countries). The web browser option does not require internet access, but rather uses point to point Wi-Fi protocol to create the communications link between the device (usually a smart phone or tablet computer) and the Vive hub. NOTE: Certain functionality described below is not available if using a web browser to access the Vive hub.

 

What Data categories do we collect, for what purpose, and who do we share it with?

 

  1. Business account information you provide:

    The primary use of the Vive system is in commercial office buildings/commercial facilities. Primary users of this App and Vive system will be a) the installing electrical contractor and b) the facility manager(s). When you install the App, you will need to establish an account with Lutron by providing an email address, password, business name and mailing address.

    Lutron uses this account Information for the following purposes:

    1. To provide you with the service of using the App to configure and control the Vive hub and the associated lighting system.

      The following is required to be provided to European Union (“EU”) users: The legal basis for use of your personal information is to perform our obligations in accordance with any contract that we may have with you. In this case, it is to provide the functionality for your App to control and configure your lighting control system.

    2. To email you important service updates, such as account password reset requests, information on security updates, technical support information, etc. We may contact you by email for service and security related communications. As an example of security related notifications: we may send an email confirming your account initiation, password changes, and similar changes for you to monitor any unauthorized access to your account. Due to their nature, you cannot opt out of receiving these service and security related emails.

      The following is required to be provided to EU users: The service providers we use are located within the United States and their use of your personal data is governed by the US Privacy Shield. The legal basis for use of your personal information is to perform our obligations in accordance with any contract that we may have with you. In this case, it is to provide security and service-related updates from us.

  2. Building/Facility information you provide.

    When you setup a project, you will be asked to provide the name, location of the building/facility and business contact information for the building occupant.

    Lutron uses this account Information for the following purposes:

    1. To help differentiate Vive hubs and lighting control products from different customers. As an electrical contractor, you may have configured Vive hubs for multiple customers and projects. Separating the lighting control products based on the building/facility allows us to offer features like handoff of the lighting control system to the facility manager, invite additional users to a specific lighting control system, etc.

      You may choose not to share this information with Lutron by opting out of Cloud Backup in the Project Details and Invites section of the App.

    2. Timeclocking. When setting up astronomic schedules, you will be asked to provide the location of the hub. We use this hub’s location to provide you with timeclocking functionality. We obtain only the general location of the hub such as the city. The exact location is not recorded by us because it is not required to provide timeclocking functionality; we only obtain the approximate location of the hub to within a .6 mile (1 km) area. Timeclocking allows you to program your system based on your sundown and sunrise times. As an example, you may program an outside light to turn on 30 minutes after sunset and turn off 30 minutes before sunrise. By providing the location of the hub you allow the system to automatically adjust as sunset and sunrise times change throughout the year. If you choose to not enter the hub’s location, you will not have the ability to program the App to events based on sundown and sunrise. You can turn off or turn on the hub’s location at any time from the hub’s settings.

    The following is required to be provided to European Union (“EU”) users: The legal basis for use of your personal information is to perform our obligations in accordance with any contract that we may have with you, in this case to provide timeclocking functionality.

  3. Lighting and technical information from the Vive Hub.

    We collect technical information from the hub to enable the system to function. Examples include: the rooms in the building, devices and all the programming associated with those devices.

    Lutron uses the lighting and technical information from the hub for the purpose of providing you with the service of having the App control your lighting control system. The information will also assist in restoring the functionality of the lighting control system in case the hub needs to be replaced. You may choose not to share this information with Lutron by opting out of Cloud Storage from the Project Details section in the App.

    The following is required to be provided to EU users: The legal basis for use of your personal information is to perform our obligations in accordance with any contract that we may have with you, in this case to provide the functionality for your App to remotely control your lighting system.

  4. For users in the United States we use commercial information and electronic network/internet activity. This is obtained from: business account and building/facility information, lighting system technical information obtained from the App and Hub, etc. This information is used internally within Lutron for product research and development, marketing, and analytical purposes. For this Lutron internal use program, we have put in place processes which allow us to look at users generally while not identifying any specific person.

  5. Your choices:

    The App provides you with the choice to:

    1. Receive marketing emails about your Vive system. You can state your preference while creating your account from the App. You may unsubscribe at any time from these emails by clicking the unsubscribe link in any marketing email you receive from us.

    2. Provide us with the relative location of a Vive hub. We use this to provide timeclocking functionality. You can remove providing the location of the hub at any time from within the hub settings section.

    3. Store building information by enabling Automatic Cloud Backup. If you enable this functionality, the building and lighting control information, including room and device names, programming details, will be stored with Lutron via a cloud services provider. This allows Lutron to offer many of the features of the Vive App such as, handoff, invites and backing up of configuration of the Vive hub. You can turn off this sharing for your building from Project Details section in the App. If you have multiple projects in the App, then you need to turn off sharing for each project individually.

    4. Initiate and remove third party integrations See: API section of the App.

      The following is required to be provided to European Union (“EU”) users: The legal basis for use of your personal information is to perform our obligations in accordance with any contract that we may have with you, in this case to provide your requested third-party integration.

    5. Anonymously share App crashes and bugs. See: Settings-Advanced-Send Crash Reports.

      The following is required to be provided to EU users: The service providers we use are located within the United States and their use of your personal data is governed by the US Privacy Shield. The legal basis for our use of your Data for the purposes described in this section is your consent.

    6. Anonymously share App usage and diagnostic information with us. See: Settings-Advanced-Anonymous usage data. When enabled, we use this information for the purpose of understanding how you use the App and to diagnose problems with the App. We hope you agree to share this information as it helps us build better products and Apps. As examples of how we use this information: we may use this information to better understand what functions of the App are used the most and about App processing errors so that we can focus software development in these areas, and we may collect the type and number of Vive devices connected to your lighting control system so that we can focus our product development and marketing initiatives. We share this information with third party providers.

The legal basis for our use of your Data for the purposes described in this section is your consent.

  6. Getting help from us

    Within the App, you may request assistance from us by sending system log files from the App to us. See: Settings-Send App Feedback. These log files may contain your business information and include a full copy of the lighting control system, including room and device names, to enable full troubleshooting. If you provide system log files to us, we use this information for the purpose of diagnosing and responding to your inquiry requesting assistance.

Your request to share data with third-party systems

Vive systems can inter-operate with third-party systems. It is your choice to permit these third-party systems to have access to your Vive system. Also, by requesting such third-party interoperability, you are requesting an ongoing transfer of your Data to the third-party system. Each third-party has varying requirements of the quantity of your Data needed for their interoperability to function. Please be aware that some thirdparties may require a complete set of your Data be continuously transferred for their interoperability to function. Third-party systems may be disabled from within the App. (Location in App: Settings-Advanced-Integrations).

For security reasons, we will need to verify that the person initiating a data request is authorized. As you must have an account for this App to function, upon our receipt of a data request we will advise you to send certain information from within the App while you are logged in to your account. We must receive the requested information within the provided time period for us to initiate your data request. Should you use an authorized agent to initiate a data request on your behalf, you will need to coordinate the sending of the required account verification information to us with your authorized agent.

Again, please be sure to include the nature of your request. You will not receive a differing level of service if you initiate a data request; initiating a request will not impact the operation of your Vive App.

If you request erasure of required operational data, certain functionality provided by the App will be lost such as: the ability to use the App to remotely access Vive hubs, Automatic Cloud Backup, etc. If you request erasure of your account, you can later create a new account and would need to re-initiate the process to access a Vive hub.

The following is required to be provided to EU users regarding Data access and rights:

You have the following rights in relation to the personal information we hold about you:

  1. Your right of access. If you ask us, we’ll confirm whether we’re processing your personal information and, if so, provide you with a copy of that personal information (along with certain other details).

  2. Your right to rectification. If the personal information we hold about you is inaccurate or incomplete, you’re entitled to have it rectified. If we’ve shared your personal information with others, we’ll let them know about the rectification where possible. If you ask us, where possible and lawful to do so, we’ll also tell you who we’ve shared your personal information with so that you can contact them directly.

  3. Your right to erasure. You can ask us to delete or remove your personal information in some circumstances such as where we no longer need it or if you withdraw your consent (where applicable). If we’ve shared your personal information with others, we’ll let them know about the erasure where possible. If you ask us, where it is possible and lawful for us to do so, we’ll also tell you who we’ve shared your personal information with so that you can contact them directly. Upon deleting your personal information, backups of personal information may linger for a bit with us before they are deleted. Also, we may need to retain certain data if required to do so for legal reasons. To remove the possibility of further data being sent to us, you should uninstall the Vive App from your device.

  4. Your right to restrict processing. You can ask us to ‘block’ or suppress the processing of your personal information in certain circumstances such as where you contest the accuracy of that personal information or you object to us processing it. It won’t stop us from storing your personal information though. We’ll tell you before we lift any restriction. If we’ve shared your personal information with others, we’ll let them know about the restriction where it is possible for us to do so. If you ask us, where it is possible and lawful for us to do so, we’ll also tell you who we’ve shared your personal information with so that you can contact them directly.

  5. Your right to data portability. You have the right, in certain circumstances, to obtain personal information you’ve provided us with (in a structured, commonly used and machine-readable format) and to reuse it elsewhere or to ask us to transfer this to a third party of your choice. We will provide the information in a common industry format to you via email upon your request.

  6. Your right to object. You can ask us to stop processing your personal information, and we will do so, if we are:

    1. relying on our own or someone else’s legitimate interests to process your personal information, except if we can demonstrate compelling legal grounds for the processing;
      or
    2. processing your personal information for direct marketing.
  7. Your rights in relation to automated decision-making and profiling. You have the right not to be subject to a decision when it’s based on automatic processing, including profiling, if it produces a legal effect or similarly significantly affects you, unless such profiling is necessary for entering into, or the performance of, a contract between you and us.

  8. Your right to withdraw consent. If we rely on your consent (or explicit consent) as our legal basis for processing your personal information, you have the right to withdraw that consent at any time.

  9. Your right to lodge a complaint with the supervisory authority. If you have a concern about any aspect of our privacy practices, including the way we’ve handled your personal information, EU users can report it to the data protection authority within your country.

International transfers of personal data

Some of the Lutron group entities and service providers are in the United States and India. We may share your provided log files with them and with a contractor located in India for select technical issues.

The following is required to be provided to European Union (“EU”) users: If you are an EU citizen/resident in the EU, please note that we will transfer your personal data to the United States and/or India in accordance with EU data protection law requirements by using standard contractual clauses that have been approved by the European Commission. Such a transfer may also be necessary in order to perform a contract with you/fulfil your request and/or through obtaining your explicit consent.

How long do we keep your personal information & how do we protect it?

Provided you continue to use the App, we will retain your data for as long as is necessary to provide the functionality you have requested. If your App is not used for 10 years, we will start the process to remove your account from our systems. You will receive at least two (2) emails advising you to log into your account in order to keep your account active. If we close your account due to inactivity you would need to create a new account to re-enable functionality. Also, if your information is only needed for a short period, we may delete it.

Lutron takes security very seriously and we follow industry best-practices around securing data, monitoring for potential abuse, and updating systems. We do not collect more personal data than we need to fulfil our purposes stated in this Privacy Notice and we will not retain it for longer than is necessary.

However, we encourage you to review this Privacy Notice periodically to be informed of how we use your personal information.

It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.
